1. Definitions
In these terms and conditions:
“CC BY-NC 4.0 License” means the Creative Commons Attribution-Non-Commercial 4.0 International License, full terms available here;
“Content” means any photograph, image, tag, description, or other material submitted by a user to the norsemap.eu web publishing platform;
“General Data Protection Regulation or GDPR” means Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC;
“Intellectual Property” means all intellectual property of any description including know-how, copyright, trademarks, database rights, design rights, patents, utility models, and applications for, and the right to apply for any of the foregoing items;
“Losses” means any claim, action, demand, proceeding, suit, judgement, loss, liability, cost, expense, fee, damages, penalty, or fine;
“Personal data” means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person, as defined under the GDPR;
“Submission” means the Submission to the Norsemap.eu web publishing platform of any item of Content;
 
2. About norsemap.eu
www.norsemap.eu (“norsemap.eu”) is a cultural heritage collection website, using a web publishing platform provided by Omeka S . Norsemap.eu has been developed as part of the NorseMap Project, funded by the European Research Council and based at University College Cork, – National University of Ireland, Cork. Ireland.
The purpose of norsemap.eu is to collect, archive and map examples of how Vikings and Norse culture are represented and used in the public domain, in order to support academic research, public engagement, and knowledge exchange.
By using norsemap.eu, you agree to these terms and conditions. These terms and conditions constitute an agreement between you and University College Cork – National University of Ireland, Cork, a university established under charter, having its seat at Western Road, Cork, Ireland (“UCC”).
 
3. How norsemap.eu works
Norsemap.eu is a public archive based around community sourcing of images. When you share an image of something relating to Viking or Norse culture and submit it to the project, you will be asked to provide information related to the image to help us identify it correctly.
In this way, you will be contributing to our goal of mapping the different ways in which the Vikings are represented in popular culture, and you will be able to see how your submission ties in with other examples of Viking heritage.
 
4. Examples of acceptable contributions
Examples of images you may submit include (but are not limited to):
Public monuments and sculptures
Graffiti
Products referencing the Vikings (such as souvenirs, produce, etc.)
Branding involving the Vikings (including business names and logos)
Tourist attractions
Landscapes or landmarks associated with the Vikings
Tattoos
Reenactment events and materials
Reconstructed Viking artefacts
Street, boat, or building names
Memes or cartoons
Political uses of the Vikings
Examples of these types of Submissions can be viewed in the ‘Browse Archive’ page on www.norsemap.eu
 
5. Prohibited Submissions
The following Content shall not be accepted:
images where a child or children (under the age of 16 years) are identified or identifiable;
graphically violent images;
Content that could contribute to a risk of harm to the physical security of persons and/or groups;
pornographic Content;
images that breach copyright or any other Intellectual Property of a third-party;
images that breach the GDPR or other applicable data protection legislation, including but not limited to:
images of identified or identifiable natural persons submitted without their permission;
images revealing any personal data relating to a natural person, including but not limited to their address, contact details, or workplace;
Content that shares, offers, or solicits personal data or other private information;
Content that is illegal in the jurisdiction in which it is taken;
offensive materials and iconography such as swastikas;
Irrelevant images which have no conceivable relationship to the Vikings;
AI-generated images;
any Content that is otherwise unlawful, misleading, discriminatory, or fraudulent.
 
5. 2 The NorseMap project operates a strict moderation policy on dealing with such Submissions (including automatic disposal of images) and reserves the right to block the use of norsemap.eu by users who submit images of this kind. Details of our moderation policy can be found at www.norsemap.eu/moderationpolicy.
 
5.3 For the avoidance of doubt, UCC shall have sole discretion to decide whether a Submission is acceptable or not, and it shall not, under any circumstances, be required to explain the reasons for its decision.
 
5.4 UCC shall be entitled to remove any Submission not withstanding any prior acceptance of the Submission. UCC shall be entitled to remove any Submission not withstanding any prior acceptance of the Submission.
 
6. Use of Norsemap.eu
6.1 Subject to these terms and conditions, UCC hereby grants you the right to use norsemap.eu to:
submit images of Viking-related material in accordance with clauses 4 and 5; and
access the educational content and other related information provided by the NorseMap project
(“the Permitted Use”).
Any use of norsemap.eu outside the Permitted Use shall not be permitted, without the prior written consent of UCC.
6.2 Whilst using Norsemap.eu, you shall not:
interfere with the intended operation of norsemap.eu;
interfere with the web publishing platform Omeka S through, or introduce any virus, malware, or bug to Omeka S through norsemap.eu;
collect or access any information in any unauthorised manner;
engage in any unlawful, misleading or fraudulent activity;
use norsemap.eu for any commercial purpose; or
impersonate others or knowingly provide inaccurate information.
 
7. Copyright of Submissions
By submitting Content to UCC via norsemap.eu, you agree to:
license the image rights to UCC under a CC BY-NC 4.0 License (which is a worldwide, royalty-free, non-sublicensable, non-exclusive, irrevocable license); and
UCC publishing the image in the NorseMap archive subject to the terms of the CC BY-NC 4.0 License.
Clause 7.1 means that UCC can reuse and adapt images you submit for non-commercial purposes as long as you are attributed via your chosen username. UCC’s reuse and adaptation of your images shall include sharing the images and other Content with other users of norsemap.eu. In accordance with the detailed terms of the CC BY-NC 4.0 License, you cannot revoke these freedoms as long as UCC follows the license terms.
Your chosen username will be credited wherever your Submission is reused (see clause 12 below).
 
8. Intellectual Property
No licence under any Intellectual Property owned or controlled by UCC in respect of norsemap.eu (or otherwise) is granted or implied by these terms and conditions other than the right for you to use norsemap.eu in accordance with these terms and conditions.
By agreeing to these terms and conditions, you confirm that in using or accessing norsemap.eu (and associated material), you will not make any unauthorised or unlawful use of:
any Intellectual Property of UCC;
any Intellectual Property of any other third-party.
UCC does not represent or warrant that any third-party material submitted to norsemap.eu is free from Intellectual Property rights or encumbrances. Each user is responsible for ensuring their own Submission does not infringe the Intellectual Property of another party, in accordance with clause 9.1(c).
 
9. Warranties & Indemnities
By submitting Content to norsemap.eu, you confirm and warrant that:
you created the image or have all necessary legal rights to submit it;
the Submission does not purport to be from someone other than yourself;
the Submission does not in any way whatsoever give rise to a violation of Intellectual Property rights (including copyright) or any existing third party right or a breach of any existing agreement (including any contract of employment), or infringe any duty of confidence or duty to respect privacy or any other right (including any moral right) of any person;
the Submission contains nothing obscene, indecent, defamatory, or libellous and all statements contained in it purporting to be facts are true;
you have not assigned or licensed and will not purport to assign or license any of the rights granted to UCC pursuant to these terms & conditions;
the rights granted to UCC by these terms & conditions are free from any security interest, option, mortgage, charge, lien, or encumbrance;
the Submission complies with these terms & conditions and all applicable laws and regulations.
You shall remain solely responsible and legally liable for any Content that you submit to norsemap.eu.
By using norsemap.eu, you also acknowledge that:
Norsemap.eu is provided “as is”;
no representation or warranty, express or implied, statutory, or otherwise, regarding norsemap.eu is given and all such representations and warranties are excluded to the maximum extent permitted by law;
no representation or warranty, express or implied, statutory, or otherwise, regarding any information, images, or other material disclosed to you on norsemap.eu is given and all such representations and warranties are excluded to the maximum extent permitted by law.
You shall indemnify and keep indemnified UCC on demand from and against any and all Losses incurred by or awarded against UCC arising out of or in connection with any breach of these terms and conditions. At the request of UCC and at your own expense, you shall provide all reasonable assistance to enable UCC to resist any claim, action or proceedings brought against UCC as a consequence of that breach.
 
10. Limitation of Liability
UCC shall not be responsible and shall have no liability for any Losses arising directly or indirectly out of or in connection with:
these terms and conditions; or
your use of norsemap.eu.
For the avoidance of doubt, UCC shall not under any circumstances be liable for any indirect damages or losses, any loss of profits, loss of revenue, loss of data, loss of contracts or opportunity, or any other consequential loss whether direct or indirect, even if UCC has been advised of or otherwise has reason to know of the possibility of those losses.
Nothing in these terms and conditions limits or excludes either party's liability for:
death or personal injury caused by that party’s negligence;
any fraud or for any sort of liability that, by law, cannot be limited or excluded.
 
11. Conflict between CC BY-NC 4.0 License and these terms and conditions
For the avoidance of doubt, these terms and conditions constitute an express private agreement between you (as user of norsemap.eu) and UCC, additional to the CC BY-NC 4.0 License (see section 7 a. of the CC BY-NC 4.0 License).
In the event of any conflict between these terms and conditions and the terms of the CC BY-NC 4.0 License (including in relation to warranties and limitations of liability (section 5 of the CC BY-NC 4.0 License)), these terms and conditions shall prevail.
 
12. Use and Preservation of Submissions
Your submitted images will be curated by the NorseMap project researchers at UCC. Accepted Submissions will be added to the repository at norsemap.eu where they will feature as a data point on the map and be viewable by the general public.
Your image may also be included in banks of images shared with other contributors using norsemap.eu or the iViking app, and in online galleries and educational exhibitions that will feature on the NorseMap website.
Further to clause 5.3, UCC shall have sole discretion to decide which Submissions to accept and which Submissions to add to the NorseMap repository. UCC shall not, under any circumstances, be required to explain the reasons for its decisions.
It is planned for the NorseMap archive, including contributors’ Submissions, to be preserved for the future through integration with the Digital Repository of Ireland (DRI) and Europeana, trusted national and EU platforms for the preservation of cultural heritage materials. At the close of the project, images may be transferred from norsemap.eu to the DRI, under the same attribution and non-commercial license (the CC BY-NC 4.0 License).
 
13. Disabling or terminating your account
Further to clause 5.2, UCC reserves the right to disable or terminate your account on norsemap.eu if it considers in its sole discretion that you have breached these terms and conditions or that your use of norsemap.eu is creating legal risk or exposure.
